COMPETITION TERMS AND CONDITIONS: Win a Brainstorm Bundle
These Terms and Conditions apply to the Win a Brainstorm Bundle (the "Competition”). The Competition can be entered by any UK resident aged 18 or above. Entrants must answer the Question (defined below) by the Closing Date (defined below) to be in with the chance to “win” a Brainstorm Bundle.
1. The Promoter
The Competition is promoted and managed by Hamleys of London Limited (CRN: 02287862) of 4th Floor, Suite A, Greencoat House, 15 Francis Street, London, SW1P 1DH (the “Promoter”) with the permission of Brainstorm (the “Prize Provider”). The Promoter is therefore responsible for the operation of all matters and concerns relating to the Competition, not the Prize Provider or any other persons involved in providing the Prize (defined below).
2. The competition
2.1 The Competition is free to enter (no purchase necessary).
2.2 The Competition is open to all GB residents aged 18 (eighteen) or above, except:
(a) employees of the Promoter or its holding or subsidiary companies;
(b) employees of agents or suppliers of the Promoter or its holding or subsidiary companies, who are professionally connected with the competition or its administration; or
(c) members of the immediate families or households of (a) and (b) above.
2.3 In entering the Competition, you confirm that you are eligible to do so. It will be the Promoter’s sole decision as to whether any eligibility requirement has or has not been met and the Promoter may require evidence or confirmation from entrants before awarding the Prize.
2.4 The Promoter will not accept entries to the Competition where they have been computer generated or are incomplete.
2.5 Only 1 (one) valid entry may be submitted per individual. Any additional entries will not be counted or eligible to win.
2.6 The Competition requires access to a Facebook account, or a Twitter account, or an Instagram account and access to a computer and internet access. This will not be provided by the Promoter nor will the Promoter be responsible for providing you with a Facebook, Twitter or Instagram account.
2.7 The Winner (defined below) must be available to take up the Prize (defined below) between the 3rd December 2021 and 3rd January 2022 (inclusive) (as set out in clause 4.5).
3. How to enter
3.1 The Competition will run from 9.00am on Thursday 2nd December 2021 (the "Opening Date") to 8.59am on Wednesday 3rd December 2021 (the "Closing Date") inclusive.
3.2 All entries received after the Closing Date are automatically disqualified.
3.3 To enter the Competition:
(a) Go to the Promoter’s Facebook, Twitter or Instagram page at [https://twitter.com/HamleysOfficial, https://www.instagram.com/hamleysofficial/, https://www.facebook.com/Hamleyslondon ] and add a comment to the following post, with your answer:
(b) Which of these animals is the Llama related to? A. Dog B. Camel C. Fish
To be in with a chance to win, you must comment with the correct answer to this question. The correct answer will be announced by the Promoter on its Facebook, Instagram, and Twitter page on 3rd December 2021. If you enter the Competition via Twitter, please note that your account must be public in order for the Promoter to see your entry.
3.4 The Promoter will not accept:
(a) responsibility for competition entries that are lost, mislaid, damaged or delayed in transit, regardless of cause, including, for example, as a result of any postal failure, equipment failure, technical malfunction, systems, satellite, network, server, computer hardware or software failure of any kind; or
(b) proof of posting or transmission as proof of receipt of entry to the competition.
3.5 By submitting a competition entry, you are agreeing to be bound by these terms and conditions.
3.6 For help with entries, please contact the Promoter at the above address or via social media direct messaging before the Closing Date.
4. The prize
4.1 1 (one) winner will be chosen from all eligible entries (those who have answered the question correctly and have complied with these terms and conditions) by a random generator on 3rd December 2021 (the “Winner”). Incorrect answers will not be counted and will not have a chance of being selected.
4.2 The names of the Winners generated will be final.
4.3 Winner will win a Brainstorm bundle, as more accurately described at condition 5.3.
4.4 The prize is provided by the Prize Provider.
4.5 The prize is
(a) Addict a Ball
(b) EUGY Parrot
(c) EUGY Llama
(d) Projector Torch
(e) 2x Stikbot
(together the “Prize”)
The Prize must be redeemed by the winner between 3rd December 2021 and 3rd January 2022 (inclusive).
4.6 The Prize is subject to availability, and such availability may be impacted by any social distancing policies and/or restrictions imposed by the Supplier from time to time. Any benefits, extras and/or activities that are additional to the prize and which are available at the time of the redemption of the Prize, are also subject to availability.
4.7 There is no cash alternative for the Prize.
4.8 The Prize is not negotiable or transferable.
5.1 The decision of the Promoter is final and no correspondence or discussion will be entered into.
5.2 The Promoter will contact the Winner via the platform they used to enter the Competition, within 7 working days from 3rd December 2021. The Winner will be asked for their full name, email address and phone number, delivery address and confirmation that they accept the Prize.
5.3 The Promoter will pass the Winners full name, email address, phone number and delivery address to the Prize Provider, who will contact the Winner to claim the Prize.
5.4 The Promoter will make all reasonable efforts to contact the winner. If the winner cannot be contacted or is not available within 48 hours of being contacted by the Promoter, the Promoter reserves the right to offer the prize to the next eligible entrant selected from the eligible entries that were received before the Closing Date.
6. Claiming the prize
6.1 Please allow 7 working days for the Prize Provider to contact you.
6.2 The prize may not be claimed by a third party on your behalf.
6.3 The Prize Provider will make all reasonable efforts to contact the winner. If the winner cannot be contacted or is not available or has not claimed their prize within 48 hours of being contacted by the Prize Provider, the Promoter reserves the right to offer the prize to the next eligible entrant selected from the eligible entries that were received before the Closing Date.
6.4 Neither the Promoter nor the Prize Provider accept any responsibility if you are not able to take up the Prize.
7. Terms and Conditions for Use of the Prize
7.1 We would like to remind you that you cannot resell, trade or otherwise transfer the Prize. You may be asked to provide the name and address and any other ID details as required, of ticket holders at any time by an official steward or employee of the Prize Provider or the venue owner or police officer.
7.2 The Winner and their Family shall not, while using Prize, display or publicize any political slogans or homophobic language, images of a lewd or explicitly sexual nature, images containing logos of competitors and overt brand sponsorship or anything else deemed to be ambush marketing or an abuse of the Prize Provider, content which is defamatory, obscene, illegal, vulgar, offensive or otherwise unsuitable or infringes others’ rights (including intellectual property rights) or reflects negatively upon the Promoter and/or the Prize Provider. Each entrant agrees and acknowledges that any breach of this clause 7.3 will cause significant damage and loss to the Promoter and/or the Prize Provider.
7.3 The Promoter may pass personal information relating to the Winner to the Prize Provider (and any of their service providers or agents) for the purposes of monitoring the distribution and use of the Prize and, in the event of a suspected breach of any terms and conditions, rules or regulations of the Prize Provider relating to the use of such tickets and/or experiences, investigating and taking action against the Winner.
7.4 Neither the Prize Provider nor the Promoter provide any guarantee in relation to the Prize cannot be held liable for any injury, loss or damage of any kind arising from the use of the Prize by the Winner or the participation of any entrant in the Competition.
8. Limitation of liability
8.1 Insofar as is permitted by law, the Promoter, its agents, or distributors will not in any circumstances be responsible or liable to compensate the winner or accept any liability for any loss, damage, personal injury or death occurring as a result of taking up the Prize except where it is caused by the negligence of the Promoter, its agents or distributors or that of their employees. Your statutory rights are not affected.
8.2 This Competition is in no way sponsored, endorsed or administered by, or associated with, Facebook, Twitter, Instagram. By Entering this Competition you hereby release Facebook, Twitter, Instagram from any and all liability and obligations relating to the Competition.
8.3 The Promoter may change these Terms and Conditions or cancel the Competition at their absolute discretion and without incurring liability as a result unless the Prize has been awarded.
9. Data protection and publicity
9.1 By entering this Competition, you understand that the Promoter (and its agents, contractors and group members on its behalf) may process, store, distribute and/or use the information (including personal data) you provide in your entry and in the process of entering:
(a) To enable them to administer your entry in the Competition, including deciding whether it accords with these Terms and Conditions;
(b) To notify you if you are a Winner. If you are a Winner you agree that the Promoter may announce or make available on request your name and county/town unless you object to the Promoters doing so or request that the amount of personal information announced or made available is reduced by the Promoters, in accordance with Clause 9.3; and
(c) To share with organisations assisting with the conduct of the Competition and fulfilment of the Prize.
9.2 Entrants’ name and contact information used for the purpose of the Competition shall be retained until for a period of 12 (twelve) months from the Closing Date.
9.3 Should any Winner object to their name and county/town of residence being announced or made available upon request by the Promoters, they should contact the Promoter at the above address. The Promoter will not announce or make available the personal information of any Winners who have objected. The Promoter may, however, need to provide such data for any lawful or regulatory purposes to a regulator.
9.4 Data will be handled in accordance with (i) any data protection legislation from time to time in force in the UK including the Data Protection Act 1998 or 2018 and any successor legislation; and (ii) for so long as and to the extent that the law of the EU has legal effect in the UK, the General Data Protection Regulation ((EU) 2016/679), and any other directly applicable EU regulation relating to privacy.
10.1 If there is any reason to believe that there has been a breach of these terms and conditions, the Promoter may, at its sole discretion, reserve the right to exclude you from participating in the competition.
10.2 The Promoter reserves the right to hold void, suspend, cancel, or amend the prize competition where it becomes necessary to do so.
10.3 These terms and conditions shall be governed by English law, and the parties submit to the non-exclusive jurisdiction of the courts of England and Wales.
