COMPETITION TERMS AND CONDITIONS: Win an Outright Games Bundle

These Terms and Conditions apply to the Win an Outright Games Bundle (the "Competition”). The Competition can be entered by any UK resident aged 18 or above. Entrants must answer the Question (defined below) by the Closing Date (defined below) to be in with the chance to “win” an Outright Games Bundle

1.                   The Promoter

The Competition is promoted and managed by Hamleys of London Limited (CRN: 02287862) of 4th Floor, Suite A, Greencoat House, 15 Francis Street, London, SW1P 1DH (the “Promoter”) with the permission of Outright Games (the “Prize Provider”). The Promoter is therefore responsible for the operation of all matters and concerns relating to the Competition, not the Prize Provider or any other persons involved in providing the Prize (defined below).

2.                   The competition

2.1               The Competition is free to enter (no purchase necessary).

2.2               The Competition is open to all GB residents, except:

(a)           employees of the Promoter or its holding or subsidiary companies;

(b)           employees of agents or suppliers of the Promoter or its holding or subsidiary companies, who are professionally connected with the competition or its administration; or

(c)           members of the immediate families or households of (a) and (b) above.

2.3               In entering the Competition, you confirm that you are eligible to do so. It will be the Promoter’s sole decision as to whether any eligibility requirement has or has not been met and the Promoter may require evidence or confirmation from entrants before awarding the Prize.

2.4               The Promoter will not accept entries to the Competition where they have been computer generated or are incomplete.

2.5               Only 1 (one) valid entry may be submitted per individual. Any additional entries will not be counted or eligible to win.  

2.6               The Winner (defined below) must be available to take up the Prize (defined below) between the Monday 27th March 2023 and Thursday 27th April 2023 (inclusive) (as set out in clause 4.5).

3.                   How to enter

3.1               The Competition will run from Sunday 26th March 2023 at 12.00pm (the "Opening Date") to 6.00pm on Sunday 26th March 2023 (the "Closing Date") inclusive.

3.2               All entries received after the Closing Date are automatically disqualified.

3.3               To enter the Competition:

(a)           Visit Hamleys, Regent Street and participate in the Outright Games Competition and claim 3 stars by:

(i)             Coming 1st in a Giganotosaurus race (Game: Giganotosaurus: Kart Racer)

(ii)           Customise Peppa’s house (Game: Peppa Pig: World Adventures)

(iii)         Complete a challenge in Justice League (Game: Justice League: Cosmic Chaos)

(b)           The entrant must complete a competition entry card, providing their full name, a valid phone number and email address, and proof of 3x stars claimed.

(c)           The entrant must choose which platform they need the game to be compatible with from Steam, PS4, PS5, Switch and Xbox.

The winners will be announced by the Promoter via a direct email to the winner’s inbox. Please note, if the prize is not accepted within the first 48 hours, a new winner will be picked.

3.4               The Promoter will not accept:

(a)           responsibility for competition entries that are lost, mislaid, damaged or delayed in transit, regardless of cause, including, for example, as a result of any postal failure, equipment failure, technical malfunction, systems, satellite, network, server, computer hardware or software failure of any kind; or

(b)           proof of posting or transmission as proof of receipt of entry to the competition.

3.5               By submitting a competition entry, you are agreeing to be bound by these terms and conditions.

3.6               For help with entries, please contact the Promoter at the above address or via social media direct messaging before the Closing Date.

3.7               Promoter shall not be held responsible for any malfunction of the entire Competition site or any system errors, failed, malfunctions, hardware or software failures of any kind, lost or unavailable network connections, typographical or system/human errors and failures, technical malfunction(s), cable connections, satellite transmissions, servers or providers, or computer equipment, traffic congestion on the Internet or at the Competition Site, or any combination thereof, including other telecommunication, cable, digital or satellite malfunctions which may limit entrant's ability to participate or proof of posting or transmission as proof of receipt of entry to the Competition. Promoter is not responsible for the policies, actions, or inactions of others, which might prevent entrant from entering, participating, and/or claiming a Prize in this Competition. Promoter may disqualify entrants who violate the rules or interfere with this Competition in any manner. If an entrant is disqualified, Promoter reserves the right to terminate that entrant's eligibility to participate in the Competition.

4.                   The prize

4.1               3 (three) winners will be chosen from all eligible entries (those who have participated in the Outright Games Competition, submitted their competition entry card, and complied with these terms and conditions) on Monday 27th March 2023 (the “Winner”).  Incomplete entries will not be counted and will not have a chance of being selected. 

4.2               The names of the Winners generated will be final.

4.3               Winners will win an Outright Games Bundle as more accurately described at condition 5.3.

4.4               The prize is provided by the Promoter on behalf of the Prize Provider.

4.5               The prizes are:

(i)             Peppa Pig: World Adventures

(ii)           Justice League: Cosmic Chaos

(iii)         Gigantosaurus: Dino Kart

(Together the “Prize”)

The Prize must be collected by the winner between Monday 27th March 2023 and Thursday 27th April 2023 (inclusive).

4.6               The Prize is subject to availability, and such availability may be impacted by any social distancing policies and/or restrictions imposed by the Prize Provider from time to time. Any benefits, extras and/or activities that are additional to the prize and which are available at the time of the redemption of the Prize, are also subject to availability.

4.7                There is no cash alternative for the Prize.

4.8                The Prize is not negotiable or transferable or be exchanged.

5.                   Winner

5.1               The decision of the Promoter is final and no correspondence or discussion will be entered into.

5.2               The Promoter will contact the Winner via email, within 7 (seven) working days from Monday 27th March 2023. The Winner will be asked for their full name, email address and phone number, delivery address and confirmation that they accept the Prize.

5.3               The Promoter will make all reasonable efforts to contact the Winner. If the Winner cannot be contacted or is not available within 48 hours of being contacted by the Promoter, the Promoter reserves the right to offer the Prize to the next eligible entrant selected from the eligible entries that were received before the Closing Date.

6.                   Claiming the prize

6.1               Please allow 7(seven) working days for the Prize Provider to contact you.

6.2               The Prize may not be claimed by a third party on your behalf. The Prize can be claimed only once.

6.3               The Promoter will make all reasonable efforts to contact the Winner. If the Winner cannot be contacted or is not available or has not claimed their Prize within 48 hours of being contacted by the Promoter, the Promoter reserves the right to offer the Prize to the next eligible entrant selected from the eligible entries that were received before the Closing Date.

6.4               Neither the Promoter nor the Prize Provider accept any responsibility if you are not able to take up the Prize. In the event Winner fails to collect the Prize within the period mentioned above, he shall be disqualified, and the next eligible entrant shall be contacted.

6.5               The Winner shall not have an option to pick the Prize; the same shall be at the sole discretion of the Promoter. The Prize cannot be exchanged for payment of additional cash in exchange of the Prize won or with some other Prize.

6.6               Once the Winner has claimed the Prize, the Promoter shall not be responsible/ liable for any issues with respect to the Prize or any claims raised with this regard.

7.                   Terms and Conditions for Use of the Prize

7.1               We would like to remind you that you cannot resell, trade or otherwise transfer the Prize.  You may be asked to provide the name and address and any other ID details as required, of ticket holders at any time by an official steward or employee of the Promoter or the venue owner or police officer.

7.2               The Winner and their Family shall not, while using Prize, display or publicize any political slogans or homophobic language, images of a lewd or explicitly sexual nature, images containing logos of competitors and overt brand sponsorship or anything else deemed to be ambush marketing or an abuse of the Prize Provider/ Promoter, content which is defamatory, obscene, illegal, vulgar, offensive or otherwise unsuitable or infringes others’ rights (including intellectual property rights) or reflects negatively upon the Promoter and/or the Prize Provider. Each entrant agrees and acknowledges that any breach of this clause 7.3 will cause significant damage and loss to the Promoter and/or the Prize Provider.

7.3               Neither the Prize Provider nor the Promoter provide any guarantee in relation to the Prize and  cannot be held liable for any injury, loss or damage of any kind arising from the use of the Prize by the Winner or the participation of any entrant in the Competition.

7.4               The Prize provided by the Promoter on behalf of the Prize provider is given on an “As is Basis”, the Promoter shall not be responsible for any issues, complaints with respect to the use or non-functioning or any claims with respect to the Prize

7.5               The Promoter shall not be held liable and shall be released from any and all claims raised with respect to the Prize distributed on behalf of the Prize Provider.

8.                   Limitation of liability

8.1               In so far as is permitted by law, the Promoter, the Prize Provider, and their agents, or distributors will not in any circumstances be responsible or liable to compensate the Winner or accept any liability for any loss, damage, personal injury or death occurring as a result of taking up the Prize except where it is caused by the negligence of the Promoter or the Prize Provider and their agents or distributors or that of their employees.

8.2               This Competition is in no way sponsored, endorsed or administered by, or associated with, Facebook, Twitter, Instagram.  By Entering this Competition you hereby release Facebook, Twitter, Instagram from any and all liability and obligations relating to the Competition.

8.3               The Promoter may change these Terms and Conditions or cancel the Competition at their absolute discretion and without incurring liability as a result unless the Prize has been awarded.

9.                   Data protection and publicity

9.1               By entering this Competition, you understand that the Promoter (and its agents, contractors and group members on its behalf) may process, store, distribute and/or use the information (including personal data) you provide in your entry and in the process of entering:

(a)           To enable them to administer your entry in the Competition, including deciding whether it accords with these Terms and Conditions;

(b)           To notify you if you are a Winner. If you are a Winner you agree that the Promoter may announce or make available on request your name and county/town unless you object to the Promoters doing so or request that the amount of personal information announced or made available is reduced by the Promoters, in accordance with Clause 9.3; and

(c)           To share with organisations assisting with the conduct of the Competition and fulfilment of the Prize.

9.2               Entrants’ name and contact information used for the purpose of the Competition shall be retained until for a period of 12 (twelve) months from the Closing Date.

9.3               Should any Winner object to their name and county/town of residence being announced or made available upon request by the Promoters, they should contact the Promoter at the above address. The Promoter will not announce or make available the personal information of any Winners who have objected. The Promoter may, however, need to provide such data for any lawful or regulatory purposes to a regulator.

9.4               Data will be handled in accordance with (i) any data protection legislation from time to time in force in the UK including the Data Protection Act 1998 or 2018 and any successor legislation; and (ii) for so long as and to the extent that the law of the EU has legal effect in the UK, the General Data Protection Regulation ((EU) 2016/679), and any other directly applicable EU regulation relating to privacy.

9.5               For more information on how data is handled by the Promoter please view the Promoter’s Privacy Policy: https://www.hamleys.com/privacy. For the avoidance of doubt, you are providing information to the Promoter and not to Prize Provider.

10.               General

10.1           If there is any reason to believe that there has been a breach of these terms and conditions, the Promoter may, at its sole discretion, reserve the right to exclude you from participating in the competition.

10.2           The Promoter reserves the right to hold void, suspend, cancel, or amend the prize competition where it becomes necessary to do so.

10.3           These terms and conditions shall be governed by English law, and the parties submit to the non-exclusive jurisdiction of the courts of England and Wales.
